1. THIS IS AN AGREEMENT BETWEEN YOU AND ADMINISTRATOR TECHNOLOGY GMBH, THE OPERATOR OF THE ADMINISTRATOR WEBSITE.
This is an agreement ("Agreement") between you and Administrator Technology GmbH. This Agreement governs your use of all Internet sites (and domains) of Administrator Technology GmbH (hereinafter referred to as "Administrator Website").
ADMINISTRATOR TECHNOLOGY GMBH OFFERS YOU THE USE OF THE ADMINISTRATOR WEBSITE ON THE CONDITION THAT YOU AGREE TO THIS AGREEMENT IN ITS CURRENT FORM. YOUR USE OF THE ADMINISTRATOR WEBSITE IS CONSIDERED AS AGREEMENT TO THE TERMS AND CONDITIONS.
2. THE ADMINISTRATOR WEBSITE
2.1 The Administrator website is a "knowledge portal about operating systems and IT topics" by IT users for IT users. On the Administrator website you will find information about resources on all operating systems (hereinafter: the "Administrator focus topic"). The contents of the Administrator website are accessible via search functions, links and a directory and come from partners such as publishers, organizers, training providers and especially community websites, as well as from Administrator Technology GmbH itself. Selected contents of the system are available to all users in addition to the website via HTML in the form of RSS feeds (XML feeds). Registered Administrator members, Administrator moderators and Administrator editors can be offered additional extended possibilities for content retrieval and provision, e.g. via programming interfaces. In addition, as a visitor to the Administrator website, you have the possibility in registered status to post content on the Administrator website in accordance with the following provisions.
2.2 You may only use the Administrator website if you are at least 16 years old and only use, request or collect data from persons who are older than 16 years old.
2.3. Administrator Visitor (anonymous): As a visitor to the Administrator website, you generally have the possibility to read content and register as an Administrator member. The information required for this is requested as part of the registration process. After successful registration, you as a new Administrator member will have the opportunity to post and edit information about resources known to you on the Administrator focus topic on the Administrator website (see 2.4). Providing a valid email address is mandatory for registration and will be validated.
2.4 Administrator Member (registered): Administrator members also have the opportunity to create their own user profile, which can also be viewed by other visitors to the Administrator website. Your own content can be viewed at any time. Administrator members can provide information on the Administrator focus topic and more in the "Manage profile" area. This information can only be viewed to a limited extent by visitors, and completely by Administrator members, provided that the Administrator member has given their consent for this content. Consent can be revoked at any time. Every personal detail can be adjusted individually. Furthermore, connections between these profiles and other content within the Administrator website may be established. Administrator Technology GmbH will also offer Administrator members the opportunity to participate in discussion forums for the exchange of opinions or to write substantive comments on the various resources stored on the Administrator website.
2.5 Administrator Moderator (registered): Administrator members have the opportunity to apply as an Administrator Moderator. Administrator Moderators are appointed by Administrator Technology GmbH at its sole discretion. Administrator Moderators are responsible for monitoring the content posted on the Administrator website, particularly with a view to whether the posted content matches the Administrator focus topic and is in accordance with applicable law. Each Administrator Moderator is responsible for their assigned area. Each area, including sub-areas, is assigned separately. Administrator Moderators have several options for managing the content in their area. This also includes the rights to move, edit or completely delete content.
2.6 Administrator Editor (selected): Administrator Moderators have the opportunity to apply as an Administrator Editor. Administrator Editors are appointed by Administrator Technology GmbH at its sole discretion. Administrator Editors are responsible for the editorial care of all areas and content. In particular, they will highlight and moderate resources available on the Administrator website. In their editorial selection and highlighting of resources, Administrator Editors should ensure that a representative selection arises from the overall spectrum of topics of the resources available on the Administrator website and do not permanently favor certain content unilaterally. Administrator Editors have several options for managing the content on the Administrator website. This also includes the rights to warn members, delete them, move content, edit content or completely delete content.
2.7 Administrator Committee: The Administrator Committee consists of members of Administrator Technology GmbH. The Administrator Committee is responsible for the content design of the Administrator website as well as for the appointment and dismissal of Administrator Moderators and Administrator Editors. The members of the Administrator Committee are determined entirely by Administrator Technology GmbH.
2.8 There is no legal claim to being granted a position as an Administrator member, Administrator Moderator, Administrator Editor and/or as a member of the Administrator Committee. Administrator Technology GmbH reserves the right to grant or withdraw the corresponding positions at its sole discretion.
2.9 No content may be posted on the Administrator website that violates applicable law. Furthermore, only content relating to the Administrator focus topic may be posted on the Administrator website. Comments should be factual in style and should have a clear substantive reference to the respective resource being commented on. Administrator Moderators, Administrator Editors, the Administrator Committee and Administrator Technology GmbH have the right to review all posted content and remove it from the Administrator website at their sole discretion. This applies in particular to illegal content as well as content that does not relate to the Administrator focus topic. Furthermore, the provisions of the following sections 9 to 13 apply. In addition, any member will be immediately excluded from the Administrator website in the event of clear abuse through deliberate false reports, copying of foreign or criminal content.
2.10 POSTING PRESS RELEASES IS NOT ALLOWED!
All content, images and files must be free of third-party rights (must originate from the author themselves). Copying existing content, images or files from other portals, forums or other websites is NOT allowed. If such content is identified, Administrator Technology GmbH reserves the right to take legal action against the Administrator member, Administrator Moderator or Administrator Editor. Content may only be added completely to the Administrator page and not just point to external download content or download URLs (e.g., PDF or WORD files). Recognizable additional links via URL for further information are permitted.
3. CONTRACT AMENDMENTS BY ADMINISTRATOR TECHNOLOGY GMBH
Administrator Technology GmbH reserves the right to change the terms, conditions and notices underlying the provision of the Administrator website at any time. It is your own responsibility to review these Terms of Use and notices as well as any additional terms posted on the Administrator website periodically. Continued use of the Administrator website after such changes take effect will be considered automatic agreement to the new contractual terms. 4. ADDITIONAL TERMS
Administrator Technology GmbH may make the use of individual functionalities of the Administrator website, such as participation in sweepstakes, dependent on further terms. In these cases, these further terms apply in addition to these Terms of Use.
5. NO COMMERCIAL, UNLAWFUL OR HARMFUL USE OF THE ADMINISTRATOR WEBSITE
The Administrator website may only be used for private purposes. Any commercial use of the Administrator website is prohibited. You may not use the Administrator website in a way that is unlawful or, in the opinion of Administrator Technology GmbH, harms affiliated companies, resellers, distributors, service providers, suppliers and/or Administrator Technology GmbH itself or customers of Administrator Technology GmbH. Administrator Technology GmbH may specify certain harmful uses in a code of conduct or specific rules published on the Administrator website, but is not obliged to do so. You may not use the Administrator website in a manner that violates the Administrator rules, the code of conduct, the behavioral guidelines or other notices valid for the Administrator website. Notwithstanding the general regulations in this section, the Administrator website may not be used in a way that damages, disables, overburdens or impairs the Administrator website or interferes with the use and utility of the Administrator website by or for third parties. Unauthorized access exceeding the norm for normal use, or direct attacks on the server structure of Administrator Technology GmbH will be prosecuted and sued for damages.
6. UNSOLICITED ADVERTISING EMAILS (SPAM EMAILS) ARE PROHIBITED AND CAUSE DAMAGE, SPAM FILTER TECHNOLOGY
Notwithstanding the general regulations in section 5, you may not directly or indirectly use the Administrator website for sending unsolicited bulk emails or unsolicited commercial emails. You agree not to use the Administrator website in a way that violates general anti-spam guidelines and laws. Violations of these anti-spam guidelines and laws constitute a breach of contract. Administrator Technology GmbH may use filter technology or other measures as part of its efforts to stop unsolicited mass emails and unsolicited commercial emails; if your use of the Administrator website includes services with email functionality, the use of such filter technology or other measures may result in some of the email messages sent or received via the Administrator website being temporarily or permanently blocked, even if these email messages do not constitute a violation of the anti-spam policy.
7. MATERIALS SUBMITTED OR PROVIDED BY YOU, COMMUNICATIONS MONITORING
7.1 Administrator Technology GmbH does not claim ownership of the materials you provide to Administrator Technology GmbH (including feedback and suggestions) or post, upload, input or submit on the Administrator website for review by the general public or by members of public or private community groups (each hereinafter referred to as "Content" or collectively as "Contents"). By posting, uploading, inputting, providing or setting up your Content, you grant us public and general perpetual, non-exclusive and irrevocable permission to use your Content, including the licensing rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Content, publish your name in connection with your Content and the right to sublicense the stated rights. This permission to use your Content in full also applies after a termination of membership. This section applies only to lawful content and to the extent that the use and publication of such lawful content does not violate applicable law.
7.2 ALL CONTENT FROM ADMINISTRATOR MEMBERS, ADMINISTRATOR MODERATORS OR ADMINISTRATOR EDITORS IS AUTOMATICALLY LICENSED UNDER THE "CREATIVE COMMONS BY-SA 4.0 LICENSE". The current Creative Commons BY-SA 4.0 License can be viewed at https://creativecommons.org/licenses/by-sa/4.0/de/.
7.3 The valid Administrator rules or Administrator discussion guidelines apply. A friendly and respectful tone should prevail on the Administrator website. For this reason, the Administrator discussion guidelines must be strictly adhered to when posting or adding content by an Administrator member, an Administrator Moderator or an Administrator Editor. The rules can be updated by the Administrator Editors at any time. The current discussion guidelines can be viewed depending on the page at https://administrator.de/help/8.
In the event of violations of the respective forum guidelines, an Administrator Moderator or Administrator Editor may warn an Administrator member and call for correction. In the event of violations by Administrator Moderators, an Administrator Editor may warn and call for correction. In the event of violations by Administrator Editors, the Administrator Committee may warn and call for correction. Also, an Administrator Moderator or Administrator Editor may at any time remove or deactivate a post, comment or link from the website if there is a suspicion of a violation of the Administrator forum guidelines. Administrator members, Administrator Moderators or Administrator Editors who deliberately or repeatedly violate these rules will be immediately excluded from the Administrator website.
7.4 Administrator Technology GmbH does not pay you any fee for your content. Administrator Technology GmbH can remove your content from the Administrator website at any time. You warrant that you possess all rights for all contributions necessary to transfer the rights as described in this section. In the event of disregard of third-party rights, copyright violations or intentional false reports, we will pass on any claims from aggrieved parties directly to the corresponding member.
8. SOFTWARE
Your use of Administrator software in connection with the Administrator website, where applicable, is subject to the End-User License Agreement ("EULA") for the respective software. If you receive software that is not accompanied by a EULA, Administrator Technology GmbH grants you a non-exclusive, revocable, personal, non-transferable license to use the Administrator software solely in connection with the Administrator website in accordance with this agreement. Administrator Technology GmbH reserves all rights to such software that are not expressly granted to you in this agreement. The software is protected by copyright laws or other laws and treaties concerning intellectual property. Administrator Technology GmbH or its suppliers remain the owners of the legal claims, copyrights and other intellectual property in the software concerned. It is licensed, not sold. You may not disassemble, decompile or reverse engineer the software, unless these actions are expressly permitted by applicable law. Administrator Technology GmbH may automatically check your version of the Administrator software and automatically download upgrades of this software to your computer to update, improve and further develop it.
9. INFORMATION ON THE ADMINISTRATOR WEBSITE
Administrator Technology GmbH and its suppliers assume no liability or guarantee for the accuracy or validity of information published on the Administrator website. This applies in particular to content posted by our Administrator members, Administrator Moderators and/or Administrator Editors. Administrator Technology GmbH expressly does not adopt these contributions as its own and is not responsible for them. All content from Administrator members, Administrator Moderators or Administrator Editors is licensed under the Creative Commons Public Domain License.
Administrator Technology GmbH and its suppliers authorize the use of information published on the Administrator website for no purpose other than private use and prohibit to the strictest possible extent the resale, redistribution and use of this information for commercial purposes.
Administrator Technology GmbH is not a broker/dealer or registered investment advisor within the meaning of securities law or the securities laws of other legal systems and does not provide legal entities with advice regarding investments in or the purchase or sale of securities or other financial products or services. 10. DISCLAIMER
10.1 THE INFORMATION, SOFTWARE, PRODUCTS AND SERVICES ON THE ADMINISTRATOR WEBSITE MAY CONTAIN ERRORS. THE CONTENT AND SERVICES AND THE INFORMATION CONTAINED THEREIN ARE PERIODICALLY CHANGED. ADMINISTRATOR TECHNOLOGY GMBH AND/OR ITS RESPECTIVE SUPPLIERS RESERVE THE RIGHT TO MAKE IMPROVEMENTS AND/OR CHANGES TO THE CONTENT, THE WEBSITE, THE SOFTWARE AND THE SERVICES AT ANY TIME. 10.4 IN THE EVENT OF SLIGHT NEGLIGENCE, ANY LIABILITY OF ADMINISTRATOR TECHNOLOGY GMBH AND/OR ITS VICARIOUS AGENTS AND LEGAL REPRESENTATIVES FOR PROPERTY DAMAGE WITH REGARD TO INDIRECT DAMAGES, IN PARTICULAR CONSEQUENTIAL DAMAGES, UNFORESEEABLE DAMAGES OR UNTYPICAL DAMAGES AS WELL AS LOST PROFITS IS EXCLUDED.
10.5 IN THE EVENT OF SLIGHT NEGLIGENCE, THE LIABILITY OF ADMINISTRATOR TECHNOLOGY GMBH IS LIMITED TO A MAXIMUM AMOUNT OF EURO 150 PER INDIVIDUAL CASE.
10.6 ANY STATUTORY STRICT LIABILITY OF ADMINISTRATOR TECHNOLOGY GMBH - IN PARTICULAR LIABILITY UNDER THE PRODUCT LIABILITY ACT AS WELL AS A STATUTORY WARRANTY LIABILITY - REMAINS UNAFFECTED BY THE FOREGOING LIMITATIONS OF LIABILITY. THE SAME APPLIES TO THE LIABILITY OF ADMINISTRATOR TECHNOLOGY GMBH, ITS LEGAL REPRESENTATIVES AND/OR VICARIOUS AGENTS IN THE EVENT OF CULPABLE INJURY TO LIFE, BODY OR HEALTH OF A USER.
10.7 SECTIONS 10.1 TO 10.6 COMPRISE ALL CONTRACTUAL AND STATUTORY CLAIMS RESULTING FROM THIS AGREEMENT OR THE USE OF THE ADMINISTRATOR WEBSITES AND SERVICES.
11. TERMINATION, ACCESS RESTRICTION
11.1 Administrator Technology GmbH can terminate this contract at any time without justification or prior notice or discontinue, restrict or suspend your access to the Administrator website. Upon termination or suspension, your right of use expires immediately. AFTER SUCH TERMINATION OR SUSPENSION, YOU CAN NO LONGER MANAGE, CHANGE OR DELETE THE INFORMATION OR CONTENT YOU HAVE STORED ON THE ADMINISTRATOR WEBSITE.
11.2 SINCE THE ADMINISTRATOR MEMBERS, ADMINISTRATOR MODERATORS AND ADMINISTRATOR EDITORS HAVE GRANTED ADMINISTRATOR TECHNOLOGY GMBH AND THE ADMINISTRATOR WEBSITE PERMISSION TO USE THEIR CONTENT INDEFINITELY AND IN FULL SCOPE PURSUANT TO POINT 7.1, THE STORED INFORMATION AND CONTENT ON THE ADMINISTRATOR WEBSITE REMAIN AFTER A TERMINATION. Deleting content would destroy existing content (e.g., discussions) in their context and make them unusable. There is no right or claim for the Administrator member, Administrator Moderator or Administrator Editor to delete their content, nickname or entire user profile. Personal data from the user profile, on the other hand, will be deleted and no longer displayed.
12. CHOICE OF LAW AND JURISDICTION FOR THE SETTLEMENT OF DISPUTES
This contract is subject to German law to the exclusion of international private law. The place of jurisdiction for disputes arising out of or in connection with this contract is Limburg/Lahn.
13. INTERPRETATION OF CONTRACT, ASSIGNMENT
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in full force and effect. Administrator Technology GmbH reserves the right to transfer this agreement in whole or in part at any time, even without notifying you. You are not entitled to transfer or sublicense this agreement or any rights to the Administrator website. Unless expressly stated otherwise herein, this agreement constitutes the entire agreement between you and Administrator Technology GmbH with respect to the Administrator website and supersedes all prior or contemporaneous agreements or proposals, whether electronic, oral or written, between you and Administrator Technology GmbH with respect to the Administrator website. The titles of individual sections of the agreement serve solely to facilitate orientation for the parties in the agreement and have no legal or contractual meaning.
14. THE FILING OF YOUR CLAIMS IS SUBJECT TO A TIME LIMIT
YOU AND ADMINISTRATOR TECHNOLOGY AGREE THAT ANY CLAIM ARISING OUT OF OR RELATING TO THE ADMINISTRATOR WEBSITE MUST BE BROUGHT WITHIN ONE-HALF (1/2) YEAR AFTER THE CAUSE OF ACTION ARISES. OTHERWISE, THE CLAIM SHALL BE PERMANENTLY BARRED.
15. COPYRIGHT AND TRADEMARK NOTICES, OTHER ACKNOWLEDGMENTS OF RIGHTS

2.7 Administrator Committee: The Administrator Committee consists of members of Administrator Technology GmbH. The Administrator Committee is responsible for the content design of the Administrator website as well as for the appointment and dismissal of Administrator Moderators and Administrator Editors. The members of the Administrator Committee are determined entirely by Administrator Technology GmbH.
2.8 There is no legal claim to being granted a position as an Administrator member, Administrator Moderator, Administrator Editor and/or as a member of the Administrator Committee. Administrator Technology GmbH reserves the right to grant or withdraw the corresponding positions at its sole discretion.
2.9 No content may be posted on the Administrator website that violates applicable law. Furthermore, only content relating to the Administrator focus topic may be posted on the Administrator website. Comments should be factual in style and should have a clear substantive reference to the respective resource being commented on. 3. CONTRACT AMENDMENTS BY ADMINISTRATOR TECHNOLOGY GMBH
Administrator Technology GmbH reserves the right to change the terms, conditions and notices underlying the provision of the Administrator website at any time. It is your own responsibility to review these Terms of Use and notices as well as any additional terms posted on the Administrator website periodically. Continued use of the Administrator website after such changes take effect will be considered automatic agreement to the new contractual terms. 7.3 The valid Administrator rules or Administrator discussion guidelines apply. A friendly and respectful tone should prevail on the Administrator website. In the event of violations of the respective forum guidelines, an Administrator Moderator or Administrator Editor may warn an Administrator member and call for correction. Also, an Administrator Moderator or Administrator Editor may at any time remove or deactivate a post, comment or link from the website if there is a suspicion of a violation of the Administrator forum guidelines. Administrator members, Administrator Moderators or Administrator Editors who deliberately or repeatedly violate these rules will be immediately excluded from the Administrator website.

11. TERMINATION, ACCESS RESTRICTION
11.1 Administrator Technology GmbH can terminate this contract at any time without justification or prior notice or discontinue, restrict or suspend your access to the Administrator website. Upon termination or suspension, your right of use expires immediately. AFTER SUCH TERMINATION OR SUSPENSION, YOU CAN NO LONGER MANAGE, CHANGE OR DELETE THE INFORMATION OR CONTENT YOU HAVE STORED ON THE ADMINISTRATOR WEBSITE.
11.2 SINCE THE ADMINISTRATOR MEMBERS, ADMINISTRATOR MODERATORS AND ADMINISTRATOR EDITORS HAVE GRANTED ADMINISTRATOR TECHNOLOGY GMBH AND THE ADMINISTRATOR WEBSITE PERMISSION TO USE THEIR CONTENT INDEFINITELY AND IN FULL SCOPE PURSUANT TO POINT 7.1, THE STORED INFORMATION AND CONTENT ON THE ADMINISTRATOR WEBSITE REMAIN AFTER A TERMINATION. Deleting content would destroy existing content (e.g., discussions) in their context and make them unusable. There is no right or claim for the Administrator member, Administrator Moderator or Administrator Editor to delete their content, nickname or entire user profile. Personal data from the user profile, on the other hand, will be deleted and no longer displayed.
12. CHOICE OF LAW AND JURISDICTION FOR THE SETTLEMENT OF DISPUTES
This contract is subject to German law to the exclusion of international private law. The place of jurisdiction for disputes arising out of or in connection with this contract is Limburg/Lahn.
13. INTERPRETATION OF CONTRACT, ASSIGNMENT
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in full force and effect. Administrator Technology GmbH reserves the right to transfer this agreement in whole or in part at any time, even without notifying you. You are not entitled to transfer or sublicense this agreement or any rights to the Administrator website. Unless expressly stated otherwise herein, this agreement constitutes the entire agreement between you and Administrator Technology GmbH with respect to the Administrator website and supersedes all prior or contemporaneous agreements or proposals, whether electronic, oral or written, between you and Administrator Technology GmbH with respect to the Administrator website. The titles of individual sections of the agreement serve solely to facilitate orientation for the parties in the agreement and have no legal or contractual meaning.
14. THE FILING OF YOUR CLAIMS IS SUBJECT TO A TIME LIMIT
YOU AND ADMINISTRATOR TECHNOLOGY AGREE THAT ANY CLAIM ARISING OUT OF OR RELATING TO THE ADMINISTRATOR WEBSITE MUST BE BROUGHT WITHIN ONE-HALF (1/2) YEAR AFTER THE CAUSE OF ACTION ARISES. OTHERWISE, THE CLAIM SHALL BE PERMANENTLY BARRED.
